Welcome to MortgageCalc. These Terms of Service ("Terms") govern your access to and use of the website located at calcowa.com/mortgage-calculator (the "Site"), including all calculator tools, blog content, educational materials, and related services provided by MortgageCalc ("we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue your use of the Site immediately.
1. Acceptance of Terms

4. Intellectual Property Rights
All content on the Site — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, calculator algorithms, blog articles, educational materials, and the overall design and layout of the Site — is the exclusive property of MortgageCalc or its content licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
The MortgageCalc name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MortgageCalc. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Site are the trademarks of their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. This license does not include the right to:
- Modify or copy the Site's source code or any calculator algorithms
- Use the Site for any commercial purpose or for the benefit of any third party
- Reverse engineer, decompile, or disassemble any software or calculator logic on the Site
- Remove any copyright, trademark, or other proprietary notices from any content
- Transfer your access to the Site to another person or entity
- Frame or mirror any part of the Site on any other server or wireless device
5. Calculator Accuracy and Limitations
The mortgage calculators, financial tools, and computational outputs provided on the Site are designed to offer general estimates only. While we employ standard financial formulas (including amortization formulas conforming to Truth in Lending Act standards), the results produced by our calculators may differ from actual loan terms, payments, and costs for the following reasons:
- Rounding and Precision: Calculator results may be subject to rounding differences. Lenders may use different rounding conventions that produce slightly different payment amounts.
- Excluded Costs: Our basic calculators may not account for all costs associated with a mortgage, including but not limited to origination fees, discount points, closing costs, title insurance, appraisal fees, recording fees, and prepaid items such as homeowner's insurance and property taxes held in escrow.
- Rate Variability: Interest rates displayed on the Site are illustrative defaults or sourced from publicly available data and may not reflect the specific rate available to you based on your credit profile, lender, loan type, property location, or market conditions at the time of your application.
- Regulatory Differences: Tax calculations, PMI rates, and insurance costs vary by state, county, and municipality. Our tools use general assumptions that may not match your specific jurisdiction.
- Program-Specific Rules: Government-backed loan programs (FHA, VA, USDA) have specific eligibility criteria, fee structures, and calculation methods that may not be fully replicated by our tools.
You should not rely solely on the output of our calculators when making any financial decision. Always verify calculations with a licensed mortgage loan originator, certified financial planner, or other qualified professional before committing to any loan, refinance, or real estate transaction.
6. Disclaimer of Warranties
THE SITE AND ALL CONTENT, TOOLS, CALCULATORS, AND SERVICES PROVIDED THEREIN ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MORTGAGECALC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- WARRANTIES THAT THE RESULTS OBTAINED FROM THE USE OF THE SITE OR ANY CALCULATOR WILL BE ACCURATE, RELIABLE, OR COMPLETE
- WARRANTIES THAT ANY ERRORS OR DEFECTS IN THE SITE WILL BE CORRECTED
No advice or information, whether oral or written, obtained by you from MortgageCalc or through the Site shall create any warranty not expressly stated in these Terms. You expressly acknowledge and agree that your use of the Site is at your sole risk.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MORTGAGECALC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, goodwill, or business opportunities
- Financial losses resulting from reliance on calculator outputs, rate estimates, or any content provided on the Site
- Damages arising from any transaction or financial decision influenced by the Site's tools or content
- Damages arising from unauthorized access to or alteration of your transmissions or data
- Cost of procurement of substitute goods or services
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, REGARDLESS OF WHETHER MORTGAGECALC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL MORTGAGECALC'S TOTAL AGGREGATE LIABILITY EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).
8. Indemnification
You agree to indemnify, defend, and hold harmless MortgageCalc, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use or misuse of the Site, or your violation of any rights of a third party.
9. Third-Party Links and Content
The Site may contain links to third-party websites, services, or resources that are not owned or controlled by MortgageCalc. These links are provided for your convenience and informational purposes only. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that MortgageCalc shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party website or service.
10. User Communications
If you send any communications, feedback, suggestions, or ideas to MortgageCalc through the Site or via email at contact@calcowa.com, you agree that such communications are non-confidential and that MortgageCalc shall be free to use, reproduce, modify, distribute, and display such communications without restriction and without obligation of compensation to you. You represent and warrant that you have the right to submit such communications and that they do not infringe upon any third-party rights.
11. DMCA Copyright Policy
MortgageCalc respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using the Site. If you believe that any content on the Site infringes upon your copyright, please send a written notification to contact@calcowa.com containing the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and its location on the Site
- Your contact information, including address, telephone number, and email address
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner's behalf
12. Termination
We reserve the right, in our sole discretion, to restrict, suspend, or terminate your access to the Site at any time, for any reason, without prior notice or liability. We may also remove or refuse to post any content from the Site for any reason. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms or the Site shall be instituted exclusively in the federal or state courts located in the State of Delaware. You consent to the personal jurisdiction and venue of such courts and waive any objection based on inconvenient forum.
Any dispute arising out of or relating to these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through the courts as described above.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the provision. If such modification is not possible, the offending provision shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions.
15. Entire Agreement and Waiver
These Terms, together with the Privacy Policy and Disclaimer, constitute the entire agreement between you and MortgageCalc regarding the use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral. No waiver by MortgageCalc of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of MortgageCalc to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
